Mr. President, Madam and Mr. Senators, it is an honor to return to the Senate floor to address the Brazilian people at a moment when we are witnessing worrisome events – and Your Excellency, Senator Girão, brought some of those facts here.

For a long time we have been denouncing from this Senate floor abuses, tramplings, and disrespect for the Federal Constitution, and this is very bad; it weakens the democratic rule of law and undermines democracy itself.
This is very harmful to the country, to national life!

I imagine the law students who are in law schools today, when they are taught about constitutional values, about the guidelines of the Federal Constitution, about what the rule of law is, due process, the adversarial principle and full defense, confronted with what is the narrative, the rhetoric, the teaching in the classroom in an academic environment and what they see outside the academic environment in real life, what is happening and, lamentably, involving the highest Court of this country.
This case of Filipe Martins is an emblematic case.

As if the action that culminated in the conviction of former President Bolsonaro and a number of other men and women, in what became nationally known as the coup plot, in a tainted process, in an incompetent forum, with judges who were clearly disqualified from judging, were not enough, we have a person who is today imprisoned for an accusation of a crime that did not occur – he is imprisoned for a crime that was not committed, for a trip he did not take, for a meeting he did not attend, yet he remains imprisoned.
Even now, former President Bolsonaro is detained. And, this week, there was a decision...
The defense requested his release because he was accused in an inquiry that involves his son Eduardo, who would allegedly be acting in the United States against Brazilian institutions, against the Brazilian State.
This gave rise to an inquiry and, in that inquiry, besides Eduardo and other people, President Bolsonaro was also accused.

And behold: the Public Ministry, as the holder of the criminal action, when proposing the opening of a public and unconditional criminal prosecution, does not charge former President Bolsonaro, because it did not find elements, because it did not find evidence, because the environment did not even allow him to have any influence over what was happening – and it would be very presumptuous to imagine otherwise.
So, it does not indict him, it refrains from indicting him. But he was detained, albeit under house arrest, because of that inquiry.
So, once there were no elements to indict him, the defense thought that his release, his liberation from custody, would be the most natural thing in the world.
So they filed a petition with the reporting judge to release Bolsonaro, because he was not indicted, because, at that time, no crime was found that could justify his detention and the precautionary measures that were imposed on him.

And, to no one's surprise – I would not like to say this phrase, but to no one's surprise, because for this magistrate there is no Constitution, there is no law; the law is what he says, the Constitution is what he speaks – he simply decides, contrary to what was in the course of the proceedings, and says: "No, he must remain detained to guarantee the possibility of applying criminal law", that is, he is presupposing that he will be convicted.
And here there is a doubt: is he referring to this process, this action, this inquiry in which, in the criminal action, he was not indicted – is he referring to the possibility of conviction in an action in which Bolsonaro is not even accused – or is he referring to another process and taking advantage of this situation to guarantee the application of criminal law in another case?
See the very Brazilian absurdity we are witnessing in Brazil at this moment – look!
That is why I say: when I imagine the law student at the grassroots being taught by a professor of Civil Law, a professor of Criminal Law, of Criminal Procedure, about what law is in Brazil, due process, the institutions of the adversarial principle and full defense, seeing all this happening in Brazil, he must be confused: "But, after all, what counts is what is in the Constitution, what is in the law, what I am learning in the academic environment, or what counts is this that I am seeing today, which has nothing to do with what is taught in the classroom?".

We will have to revisit this period at some point or else we will no longer live under the rule of law in Brazil, which is sad, because not even in exceptional periods can measures of this nature be admitted, measures that exceed, that challenge legality, that challenge the Federal Constitution, yet we are witnessing events of this magnitude and seriousness.
And this case of Filipe Martins seems to me another aberration, because they accuse him of having made a trip he did not make; they accuse him of having participated in a meeting he did not attend.

What seems evident to me is an attempt – and there, from the moment he is arrested and even subjected to detention measures in an inappropriate environment, he was placed in an improper setting – what was sought there or what is sought in that environment of illegal detention is a coerced cooperation agreement.
Now, unlike before, and unlike in the past, he did not make a cooperation agreement.
He did not do it because he did not want to or because he had nothing to report.

Now, what is being revealed by the evidence and by the facts is this whole fraudulent procedural plot, this whole staged procedural scheme that is exposing a judicial process riddled with nullities and contradictions as repugnant as one can imagine.

Now, if this happens at the instance where it happens, in the forum where it happens, what can be said about abuses that may occur at the first instance?
Because, if in the highest Court, which should set the example and should be the path to restrain those who dare to abuse the power to judge...

Brazil is living in a dangerous environment. If we do not correct course, we will go from bad to worse.

We are not setting an example for anyone. But, Mr. President, while I made these brief remarks regarding the current situation in Brazil, I also wanted to bring a point that concerns me greatly in relation to my State of Rondônia, regarding public security in my state.

Rondônia is experiencing an absolutely worrying moment, especially regarding public security.
My state, which has always been proud to be a land of hardworking people, of peaceful people, a peaceful land, is seeing violence grow alarmingly.
And what used to be a problem only in our capital...
And I saw earlier Senator Marcio Bittar speaking of the increase in violence, Your Excellency also giving examples of the states where the highest rates of violence exist, states governed by the PT – where the left governs, the violence is more striking.

And what I have to say here is that in my state, although the PT is not governing, we have seen violence grow in recent years in an alarming way.
And this has worried me greatly, because what was already serious – having a level of violence above average in my capital, Porto Velho – now, also in the interior of my State of Rondônia, violence is increasing, organized crime is taking hold.

And what I observe is that, as the State fails to take up its duty...
That is, there are situations in which the State must be present.

It must be present not only with the repressive apparatus, not only with ostensive policing, not only with criminal investigation police, not only with the prison police; that is, you have the police that prevent crime, you have the police that investigate crime, and you have the police that, once a convict is incarcerated, guard the environment so that he remains there, has no connection to the outside and does not control criminal life outside prison.
It is not only that; the presence of the State is not limited to that.
