Marcos Rogério: And, if in other times, Mr. President, the Judiciary was the balancing scale in the sense of defusing conflicts, now it is the one at the center of the crisis.
Marcos Rogério: The STF (Supreme Federal Tribunal), a court that by the Constitution should be the guardian of the law and the balance between the Powers, lamentably has taken on the contours of a court of exception, moving away from the limits imposed on it by the democratic rule of law.
It is increasingly evident — and we cannot ignore this — that there is an erosion of the most elementary principles of criminal procedure, among them due process, broad defense, adversarial proceedings, the principle of the natural judge, the legal institutes of impediment and suspicion, abandoned long ago, institutes that ensure impartiality of the adjudicator.
Marcos Rogério: All of this has been set aside. Due process is not a constitutional ornament, it is the backbone of the Justice system.
Marcos Rogério: It is what guarantees every citizen, whether we like their opinions or actions or not, the right to be tried by an impartial judge, in observance of procedural rules, with due respect for broad defense and adversarial proceedings.
