Sérgio Moro: But within this matter there is a very important point: the rules against habitual tax debtors.
Sérgio Moro: We saw, last week, a reflection of the leniency of our current system toward those who have no limits in the exploitation of economic activity and who disregard the rules.
There are companies that are formed primarily to trade and to engage in apparently legitimate activity without fulfilling the obligations to which all other taxpayers are subject, thus giving them a competitive advantage in the market that ends up affecting other companies.
Sérgio Moro: I, personally, as a judge, had cases in which I witnessed import companies that were created and operated for roughly a year and did not pay any taxes, paying only those levies they could not avoid — notably Import Duty — as well as PIS-Cofins and taxes on profits.
Sérgio Moro: They paid nothing. And they competed in the market with large companies, enjoying a competitive advantage over other companies.
