Marcos Rogério: When we talk about strengthening the regulatory agencies, we are precisely talking about strengthening Brazil's infrastructure, because these agencies, since 1990, have been the instrument that the Brazilian State created precisely to enable the entry of the private sector into Brazil's structuring solutions.
Marcos Rogério: In other words, the public sector was unable to provide answers to the problems of national infrastructure, and the private sector was called upon to participate.
And it is precisely the regulator who fulfills the task of ensuring an environment of predictability, legal certainty, and regulatory certainty.
Marcos Rogério: So, Mr. President, Law No. 13,848, the so-called General Law of the Agencies, consolidated that choice: fixed terms for agency directors; technical, decisional, administrative and financial independence.
Marcos Rogério: The law was clear: the regulatory agency is not an arm of the government in office, it is a State body; but there is a contradiction that needs to be stated clearly.
