Marcos Rogério: From the material standpoint, the proposal is compatible with the Federal Constitution.
Marcos Rogério: The proposed amendment does not constitute an innovation incompatible with the Brazilian fiscal regime, since art. 9, §2, of the Fiscal Responsibility Law already foresees cases of expenditures exempted from the limitation on commitments.
The bill, therefore, does not set aside fiscal responsibility, but adjusts its instruments to the institutional nature of the federal regulatory agencies, whose activities require stability, predictability and operational continuity.
Marcos Rogério: On the merits, PLP 73, of 2025, is convenient and timely.
Marcos Rogério: The federal regulatory agencies perform strategic functions in essential sectors of the economy, such as energy, transport, telecommunications, supplementary health, sanitation, mining, oil and gas, health surveillance, civil aviation and data protection, among others.
