Marcos Rogério: It is increasingly evident — and we cannot ignore this — that there is an erosion of the most elementary principles of criminal procedure, among them due process, broad defense, adversarial proceedings, the principle of the natural judge, the legal institutes of impediment and suspicion, abandoned long ago, institutes that ensure impartiality of the adjudicator.
Marcos Rogério: All of this has been set aside. Due process is not a constitutional ornament, it is the backbone of the Justice system.
It is what guarantees every citizen, whether we like their opinions or actions or not, the right to be tried by an impartial judge, in observance of procedural rules, with due respect for broad defense and adversarial proceedings.
Marcos Rogério: That is not what we see, and the world is watching.
Marcos Rogério: What we are witnessing in the STF, however, is the concentration of powers that should alarm everyone: a justice initiates the inquiry, investigates, brings the accusation, judges, imprisons and even claims to be a victim.
