When there is an arrest in flagrante, the person arrested is brought before the judge, and the judge decides whether they remain detained or are released.
Sérgio Moro: And, although the judge is often correct, there are cases in which dangerous criminals have been released, especially professional criminals, repeat offenders, including also people who were arrested at custody hearings, had been previously released, but who end up being set free.
Sérgio Moro: CNJ statistics point to about 40% of these releases, and this has generated a feeling of impunity.
