Sérgio Moro: So, the first and most important thing at the moment was this retraction by Minister Gilmar Mendes, who went back on the restriction regarding the legitimacy to propose impeachment.
Sérgio Moro: Note that the two most relevant impeachments in Brazil's history, that of President Fernando Collor, over the PC Farias scheme, and the impeachment of President Dilma Rousseff, for the fiscal juggling carried out, resulted from petitions submitted by Brazilian citizens who held no office, no public authority.
It is important, in a democracy, to keep channels open for citizens.
Sérgio Moro: I hope that, in the assessment of this injunction by the Plenary of the Senate, the 1950 Impeachment Law can be fully restored, also with respect to other aspects, such as the quorum necessary for the admissibility of an impeachment request against a Supreme Court Justice, which in the law is a simple majority, and yet the injunction creatively transformed it into a qualified two-thirds quorum, which has no normative support in our Constitution.
Sérgio Moro: If there is dissatisfaction with the quorum provided in the law, change the law, but you cannot do that by judicial shortcuts, much less by single-judge decisions.
