Marcos Rogério: We had the opportunity to debate this matter, dear Rapporteur Senator Esperidião Amin, in the Infrastructure Commission of the Federal Senate.
Marcos Rogério: We brought to the Infrastructure Commission representatives from ANTT, from the Federal Highway Police, truck drivers, and we debated this issue.
We even thought, at that time, that it would be an easy equation, merely a matter of common sense, but that was not the path, that was not the understanding during those debates, although the public hearing helped to make some points even clearer, above all the need to approve this proposed constitutional amendment.
Marcos Rogério: PEC 22 of 2025 addresses a basic point: a truck driver should not be punished for failing to do what the State was unable to do and provide.
Marcos Rogério: We all support mandatory rest. That represents, means safety for everyone – for the truck driver and for road users – but the reality of Brazilian highways is totally different from that abstract world that the Executive Branch and, sometimes – many times – even the Legislature construct.
